I. Definitions
The Data Controller and operator of the website www.viduje.com (hereinafter referred to as the Seller) is MB “Tvaru”, company code 304574045, registered address Vydūno g. 27-13, LT-06208 Vilnius, Republic of Lithuania, email address: info@viduje.com.
The Buyer is a legally capable natural or legal person who has purchased Goods in the online store https://viduje.com/.
The Parties refer jointly to the Buyer and the Seller.
Viduje.com – the online store operating at www.viduje.com.
Personal Data – any information relating to a natural person (data subject) whose identity is known or can be directly or indirectly identified using such data as a personal identification number or one or more physical, physiological, psychological, economic, cultural, or social characteristics.
Goods – all items sold in the online store viduje.com. The terms “good” and “goods” used in these Rules shall refer to both singular and plural forms.
Rules for the Purchase and Sale of Goods (hereinafter – the Rules) regulate the rights and obligations of the Buyer and the Seller, Goods prices, payment procedures and deadlines, delivery, quality guarantees, returns and exchanges of Goods, and liabilities.
Privacy Policy – a document approved by the Seller setting out the main rules for the collection, storage, processing, and retention of Personal Data when using viduje.com.
II. General Provisions
These Rules for the Purchase and Sale of Goods, once approved by the Buyer (by reviewing the Rules and ticking the checkbox “I have read and agree to the website terms and conditions”), constitute a binding legal document for the Parties and establish the rights and obligations of the Buyer and the Seller, the conditions for purchasing and paying for Goods, delivery and return procedures, liability, and other provisions related to the purchase and sale of Goods in the online store.
The Seller reserves the right to amend, modify, or supplement the Rules at any time in accordance with legal requirements.
By approving the Rules, the Buyer confirms that they have the legal right to purchase Goods in the viduje.com online store.
The Buyer is informed that the Rules may be amended due to changes in legal regulation. It is recommended that the Buyer review the Rules each time before placing an order to ensure full understanding of the applicable conditions.
The Buyer must familiarize themselves with the Seller’s approved Privacy Policy. Consent or refusal regarding specific uses of the Buyer’s Personal Data is expressed in accordance with the procedures set out in the Privacy Policy.
Where the Seller is entitled or obliged to provide documents or information to the Buyer by email, the Buyer is responsible for providing a valid and functioning email address.
III. Privacy Policy
MB “Tvaru”, when conducting e-commerce activities, complies with the Law on Legal Protection of Personal Data of the Republic of Lithuania, the General Data Protection Regulation (EU) 2016/679, and other legal acts governing the processing and protection of Personal Data.
The Privacy Policy forms an integral part of these Rules.
IV. Goods
Images of Goods displayed in the online store are for illustrative purposes only. Although the Seller makes every effort to display colors as accurately as possible, the Seller cannot guarantee that the Buyer’s device screen will accurately reflect the actual colors of the Goods. The Buyer acknowledges that the Goods may differ slightly from their images.
The packaging of Goods may differ from that shown in the images displayed in the online store.
All Goods offered in the online store are available for purchase. If ordered Goods become unavailable, the Buyer will be immediately informed by email or other means (phone call and/or SMS), and the order for such Goods will be cancelled.
A purchase–sale agreement between the Buyer and the Seller is deemed concluded when the Buyer selects the Goods, forms a shopping cart, clicks “Order”, and the Seller confirms the order by contacting the Buyer via the provided phone number or email and sending an order confirmation email.
Each purchase–sale agreement concluded between the Buyer and the Seller is registered and stored in the online store’s database.
V. Buyer’s Rights
The Buyer has the right to access their Personal Data and request correction of incorrect, incomplete, or inaccurate Personal Data by emailing info@viduje.com. The Seller must implement such requests without delay (within 1–2 business days).
The Buyer may exercise the right to withdraw from the purchase–sale agreement only if the Goods have not been damaged, have not substantially changed in appearance, have not been used, and remain in their original packaging.
If the Buyer purchases Goods of inadequate quality from viduje.com, they have the right to request replacement with Goods of proper quality or to return the Goods.
VI. Buyer’s Obligations
The Buyer must pay for the Goods and accept them in accordance with these Rules.
If the information provided in the order form changes, the Buyer must immediately inform the Seller.
By using the viduje.com online store, the Buyer undertakes to comply with these Rules, other conditions clearly stated on the website, and the laws of the Republic of Lithuania.
VII. Seller’s Rights
The Seller has the right to set a minimum order value at its discretion.
If the Buyer attempts to undermine the stability or security of the online store or violates obligations, the Seller may immediately restrict or suspend access to the online store or, in exceptional cases, cancel the Buyer’s registration.
In the event of significant circumstances, the Seller may temporarily or permanently suspend the operation of the online store without prior notice. Confirmed orders will be fulfilled, while new orders will not be accepted.
The Seller has the right to cancel an order without prior notice if the Buyer selects bank transfer payment and fails to pay.
The Seller may conduct marketing campaigns and, with prior consent, inform Buyers via their provided contact details. The Seller may unilaterally modify or terminate marketing campaigns at any time.
If the Seller cannot fulfill an order on time for valid reasons, the Seller may change delivery conditions or cancel the order, immediately informing the Buyer and refunding the payment.
VIII. Seller’s Obligations
The Seller undertakes to provide the Buyer with access to services of the online store https://viduje.com/ under the conditions set out in these Rules.
The Seller undertakes to respect the Buyer’s right to privacy and to process Personal Data in accordance with Lithuanian law.
The Seller undertakes to deliver the ordered Goods to the address specified by the Buyer under the stated conditions.
If delivery of the ordered Goods is impossible due to significant circumstances, the Seller will offer a similar or equivalent product. If the Buyer refuses, the Seller will refund the payment within 14 business days or cancel the order if no payment was made.
If the Buyer returns Goods, the Seller undertakes to refund the paid amount within 14 business days from the date the Goods are returned.
IX. Prices, Payment Procedure, and Deadlines
All prices are indicated in euros, including VAT.
Prices confirmed by the Seller may not change unless due to technical errors or objective reasons beyond the Seller’s control. In such cases, the Buyer may cancel the order within two (2) business days and receive a full refund.
Payments are made via online banking. Orders are processed only after payment is received.
Payments are processed through MakeCommerce.lt using Swedbank, SEB, Luminor, Citadele, and Šiaulių Bankas.
The Seller reserves the right to require the Buyer to sign a purchase order agreement.
VAT invoices include Goods details, quantities, discounts, final price including taxes, and other legally required accounting information.
X. Delivery of Goods
When placing an order, the Buyer may choose delivery to an address or collection at the Seller’s pickup point.
XI. Delivery to the Buyer’s Address
The Buyer must provide an accurate delivery address and accept the Goods personally or via an authorized person.
Delivery costs depend on the chosen delivery method.
Delivery times are preliminary and may be delayed due to circumstances beyond the Seller’s control.
The Seller is not liable for damage caused during transportation or due to external factors.
The Seller is released from liability for delivery delays caused by the Buyer.
XII. Returns and Exchanges
Goods purchased at viduje.com may be returned or exchanged in accordance with the Civil Code of the Republic of Lithuania and Retail Trade Rules.
Underwear is non-returnable.
Return shipping costs are borne by the Buyer.
Refunds are issued only via bank transfer to the payer’s bank account.
XIII. Liability
The Buyer is fully responsible for the accuracy of Personal Data provided.
The Seller is not liable for damages arising from the Buyer’s failure to review these Rules.
The Seller is not responsible for third-party websites linked from the online store.
XIV. Communication
All notices are sent to the Buyer’s provided email address.
Written communication includes email.
XV. Final Provisions
These Rules are governed by the laws of the Republic of Lithuania.
Disputes are resolved through negotiation or in Lithuanian courts.
